This is the new Covenant and Rule Enforcement Policy and Procedure, adopted by the Pine Creek Board of Directors, and effective August 10, 2022. Please note that this policy update was generated in response to legislation change, and the Board and Management company is obligated to operate within compliance of State Law. This is also posted on PCVA.org and your Homeowner Portal for easy access. Please review the below, notable points in this policy:
- Owners should submit any complaints via writing, meaning email or first-class mail (oral or anonymous complaints are not considered.)
- Notice of Violations will be sent via certified mail, as well as first-class mail. Additional notices may be sent via email if one is provided, or by hand-delivery.
- Hearings may be requested by owners only when requested in writing prior to the deadline stated in the notice of violation.
- Limitation of Fines are restricted to $500 PER Violation of the Governing Documents unless the nature of the violation threatens public safety or health.
- Administrative Expenses related to the covenant and rule enforcement will be charged back to the owner (or applied to their homeowner ledger) which generated the violation (cost for postage, certified mailing, hand-delivery by process server, cost to translate a document into another language other than English, etc.)
- Fine Schedule/Notice Schedule:
- First Violation/Warning $0, 30 days; notice will warn of $75 fine to be applied if not cured
- Second Violation/1st Fine Notice$75, 30 days; fine applied; notice will warn of $150 fine to be applied if not cured; HOA may proceed with legal action
- Third Violation/2nd Fine Notice$150, 7 days; Fine applied; notice will warn of $275 to be applied if not cured
- Fourth Violation/3rd Fine$275, 7 days; fine applied
