The draft law allows HOAs to prohibit ADUs within the association, and your Pine Creek Village Association Board intends to follow the intent of PCVA’s originating documents, which specify single-family homes. However, Accessory Dwelling Units—or ADUs—is a term not found in PCVA’s documents, forcing the Board to recommend an amendment to our Declaration (and any other necessary documents) that prohibits the addition of ADUs within Pine Creek Village Association.
An amendment requires a vote of all homeowners, with time for review and comment. The Association attorneys are preparing the amendment now, to be shared with homeowners when it is available.
Until this vote can be taken and the results recorded, your PCVA Board will uphold the intent of our Association, as documented, and deny any application for additions or modifications that would result in multi-family lots or residences.
